Whether you’re enforcing the law, defending someone in court, or simply trying to understand what your character has been charged with, the current Penal Code should be your starting point.

Using the Penal Code

The Penal Code should be used when determining:

Criminal Offenses

Determine what offense may apply and how that offense is classified.

Fines & Sentencing

Review the penalties and sentencing guidance attached to an offense.

Rights & Authority

Review recognized rights and the lawful authority available to government personnel.

Legal Arguments

Support legal interpretation, defense arguments, prosecution decisions, and court review.
The Penal Code establishes the legal framework, but individual cases may still be affected by:
  • The facts of the case
  • Available evidence
  • Court rulings
  • Applicable precedent
  • Legal motions
  • Other recognized legal authority
Not every case is identical simply because the charge is the same.

Charges & Sentencing

Law enforcement and the Department of Justice are expected to use the current Penal Code when determining criminal charges and potential sentencing. Charges should reasonably reflect the conduct that actually occurred during the roleplay. The goal is not to stack every technically possible offense onto a defendant. The goal is to reach a reasonable and consistent legal outcome based on the facts and evidence of the case.
When a charge, interpretation, or legal outcome is disputed, the court system exists to resolve that disagreement through roleplay.

Knowing the Law In Character

The Penal Code is an in-character legal resource. Citizens may reasonably access, read, and reference the laws of San Andreas just as they could access laws within a real government system. That does not mean every character is expected to be a legal expert. Different characters will naturally understand the law at different levels. For example:
  • Attorneys should have a strong understanding of legal procedure and interpretation
  • Judges and prosecutors should understand the laws relevant to their duties
  • Law-enforcement personnel should understand the offenses and authority relevant to enforcement
  • Ordinary citizens may know some laws well and others only generally
When your character needs legal advice, sometimes the best answer is not another paragraph of the Penal Code.Call an attorney. That’s roleplay too.
